Changes to the Amazon Publisher Services Agreement posted on June 4, 2019
Here are some important updates we made to the agreement. This list is not exhaustive of all updates, so please review the full text of the updated agreement carefully.
- Clarified that if you integrate the Program Materials onto third party devices, you may be subject to the additional terms of those third party devices.
- Clarified that you will not export technology to any country, individual or entity where such export is restricted or prohibited. Additionally clarified that the agreement does not require either party to act in a manner that is inconsistent with US law.
- Clarified the definitions of “Child” or “Children” to include, in addition to COPPA, other applicable laws.
- Clarified that Precise Location Data (i.e., lat/long) does not include IP address.
- Clarified that, as a controller, you must determine your processing basis for the EU personal data that you provide to us and must satisfy the applicable legal requirements related to that processing basis.
- Clarified that video ads may be muted by the video player at first play but cannot otherwise be muted without user interaction.
- Clarified in Unified Ad Marketplace Program Specific Terms and Private Marketplace Program Specific Terms that, for ads not delivered through Amazon Advertising, we will not pay you if we have not received payment from the third party who delivered the ad or if such payment was clawed back. If we’ve already made payment to you, we reserve the right to adjust future payments accordingly.

- Clarified the definitions of personal information and consent.
- Clarified that you and Amazon Europe Core S.a r.l. are each independent data controllers with respect to EU personal data.
- Carved out breaches of EEA data protection and privacy laws from our mutual uncapped indemnification liability.

- Clarified that separate software licenses (if any) will be indicated as a schedule to Program Materials or in files distributed with the software.

- Clarified publicity section with respect to Site names.
- Removed reference to legacy master service agreements for internet advertising.

- Clarified that user related information that you may send us or that we may collect such as, an advertising-specific identifier, a full IP address or Precise Location Data is not Site Data.

Here are some important updates we made to the agreement. This list is not exhaustive of all updates, so please review the full text of the updated agreement carefully.
- Clarified that Ads placed under the Amazon Demand Program Specific Terms are provided by us or on behalf of third party advertisers who participate in Amazon Advertising.
- Clarified that third parties receiving Aggregated and Anonymous Collected Data are bound by confidentiality, non-use and disclosure obligations at least as restrictive as those imposed on you.
- Clarified that we do not pay for Ads appearing in violation of the Editorial Adjacency Policy.
- Clarified that if a violation of Editorial Adjacency Policy results in under-delivery section 3(k) of the Terms Applicable to Non-Programmatic Ads applies.
- Clarified that we may place or facilitate the placement of pixels or cookies (including cookies associated with your domain) on the browsers of users visiting the Sites.
- Added the Private Marketplace Program Specific Terms.
- Added the Unified Ad Marketplace Program Specific Terms.
